Opulent Cruises Booking Terms & Conditions

Opulent Cruises is a travel agency dedicated to providing exceptional travel arrangements on behalf of Service Providers such as cruise companies, airlines, hotels, and transportation services. Before booking your travel with me, please read the following terms and conditions carefully to understand your rights and obligations.

1. Booking Process:

Opulent Cruises acts as a booking agent on behalf of the Service Provider (hereinafter referred to as "the Provider"). Booking requests made through Opulent Cruises are subject to availability and confirmation as well as the Terms & Conditions of the Provider.
Bookings are subject to availability and changes of the Provider at the time of booking and may be different from when a quote was made or if a provisional booking was held.
By making a booking through Opulent Cruises, you acknowledge that you have read, understood, and agreed to these Terms & Conditions as well as the Terms & Conditions of each supplier involved.
When you book a travel service (flights, hotels, tours, cruises, etc.) via the online booking engine on our Opulent Cruises website, you acknowledge that the booking is made through a third-party provider. You are responsible for reviewing and understanding the terms and conditions of the third-party provider, in addition to our own terms and conditions. The third-party provider's terms may differ from ours and may include cancellation policies, fees, and other restrictions.
The Opulent Cruises online booking engine is designed to allow clients to make bookings independently. If you choose to book without consulting an agent at Opulent Cruises beforehand, Opulent Cruises cannot be held liable for any errors or issues arising from the booking process. Please ensure all information is correct before confirming your booking. Opulent Cruise will always be of assistance should any problem arise. Opulent Cruises will make contact with the “booker/client” for any further assistance or advice should a booking be made on the Opulent Cruises third-party booking engine.

2. Responsibility:

Opulent Cruises acts solely as an intermediary between the passenger/traveller and the Provider. Opulent Cruises is not responsible for the operation or provision of the cruise/travel services, facilities, or any other aspect of the cruise/flight/hotel/transportation itself.
Opulent Cruises is not liable for any loss, damage, injury, or death resulting from the acts, omissions, or negligence of the Provider or any third party involved in the provision of the cruise/travel services.
By completing a booking online through Opulent Cruises website and Provider booking engine, you confirm that you have carefully reviewed your booking details, including travel dates, personal information, and payment information, before finalizing the transaction. You are solely responsible for any errors made during the booking process. This includes, but is not limited to, incorrect travel dates, destinations, or personal details.

3. Liability:

Opulent Cruises shall not be liable for any visa requirements, separate airfares, travel insurance, or any other additional services not explicitly included in the booking confirmation provided by the Provider.
Any claims for refunds, compensation, or damages arising from issues related to visa, airfares, travel insurance, or other additional services booked outside or booked by Opulent Cruises must be directed to the Provider in accordance with their terms & conditions.
Opulent Cruises shall not be liable for any bodily injury, death, property damage, or other damages that result from your participation in any travel activities or your use of Services booked through us. The liability for such incidents lies solely with the Provider as per their terms & conditions.

4. The Provider's Terms and Conditions:

All bookings made through Opulent Cruises are subject to the terms & conditions of the Provider. Passengers/Travellers are bound by the Provider's terms & conditions, which may include but are not limited to cancellation policies, payment schedules, and liability limitations.
Opulent Cruises shall provide passengers/travellers with access to the Provider's terms & conditions upon request or at the time of booking.

5. Health and Safety:

You acknowledge that you are responsible for your own health and safety during your travel and that of any minors traveling with you. Opulent Cruises is not liable for any health-related issues or safety concerns that arise during your trip. If you are pregnant, please check the terms & conditions of the Provider.

6. Documentation:

You are responsible for obtaining all required travel documents, including visas, permits, passports, and vaccination certificates. Opulent Cruises is not responsible for providing advice or services related to obtaining these documents.

7. Travel Insurance:

Opulent Cruises strongly recommend purchasing comprehensive travel insurance that covers cancellations, medical expenses, loss and damage to personal belongings, and other travel-related risks. Opulent Cruises does not provide travel insurance and is not liable for any losses or damages that could have been covered by such insurance.

8. Payment and Cancellation:

Payment and cancellation policies vary depending on the Provider. Passengers/Travellers are responsible for familiarizing themselves with the payment and cancellation terms specified by the Provider.
Opulent Cruises may collect payments on behalf of the Provider in accordance with the Provider's payment policies. All payments made through Opulent Cruises are subject to the Provider's terms & conditions.
Opulent Cruises reserves the right to retain its service fee or commissionable amount in the event of a cancellation by the client, subject to the cancellation policies of the Provider. The specific amount retained by Opulent Cruises shall depend on the nature of the cancellation and the applicable cancellation fees.
Opulent Cruises Cancellation Fee prior to full payment -15% of commissionable amount included from Provider (subject to reason for cancellation upon discussion/rebooking) plus any Provider fees as per Provider cancellation terms & conditions.
Opulent Cruises Cancellation Fee after full payment (within cancelation penalties) – 100% of commissionable amount included from Provider (subject to reason of cancellation upon discussion/rebooking) plus any Provider fees as per the Provider cancellation terms & conditions.

9. Changes and Amendments:

Any changes or amendments to a booking made through Opulent Cruises are subject to the Provider's approval and may be subject to additional fees or charges as determined by the Provider.
Opulent Cruises shall make reasonable efforts to accommodate change requests but does not guarantee the availability of requested changes.
Opulent Cruises Change Fee - $0 plus any applicable Provider fees. Opulent Cruises earns commission on bookings made and will not charge for additional changes made to an existing booking.

10. Dispute Resolution:

Any disputes or claims arising from or relating to a booking made through Opulent Cruises shall be resolved in accordance with the dispute resolution mechanisms outlined in the Provider's terms & conditions.

11. Governing Law:

These terms & conditions shall be governed by and construed in accordance with the laws of Australia. Any disputes arising under these terms & conditions shall be subject to the exclusive jurisdiction of the courts of Australia.

11. Severability:

If any provision of these terms & conditions is found to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired in any way.

12. Acceptance:

By making a booking through Opulent Cruises directly with an agent or via the Opulent Cruises website using the third-party booking engine, you acknowledge that you have read, understood, and agreed to Opulent Cruises terms & conditions, as well as the terms & conditions of the Provider's involved.

Opulent Cruises reserves the right to update or modify these terms & conditions at any time.
